
Reactionary radio host and white supremacist Hal Turner was taken into custody Wednesday after remarks urging Catholics to "take up arms" against two Connecticut lawmakers and a state ethics official over legislation being considered in the state legislature regarding the church.
Connecticut Capitol police got a warrant for Turner's arrest. The Hartford Courant fills in the details:
Turner, who has been identified as a white supremacist and anti-Semite by several anti-racism groups, hosts an Internet radio program with an associated blog. On Tuesday, the blog included a post that promised to release the home addresses of state Rep. Michael Lawlor, state Sen. Andrew McDonald and Thomas Jones of the State Ethics Office.
"Mr. Turner's comments are above and beyond the threshold of free speech," Capitol Police Chief Michael J. Fallon said in an e-mail announcing the warrant. "He is inciting others through his website to commit acts of violence and has created fear and alarm. He should be held accountable for his conduct."
The remarks on the blog were a reaction to the recent controversy over a bill that would have changed the way the Roman Catholic Church is governed, taking power away from church officials and turning it over to lay members. It was pulled in mid-March following an outcry from Catholics across the state and questions about its constitutionality.
Turner used to be a regular on Sean Hannity's radio show (the Fox news pundit). When Hannity said he didn't have an association with Turner earlier this year, Turner wrote:
I was quite disappointed when Sean Hannity at first tried to say he didn't know me and then went on to say that I ran some senate campaign in New Jersey. In fact, Sean Hannity does know me and we were quite friendly a number of years ago.
When Hannity took over Bob Grant's spot on 77 WABC in New York City, I was a well-known, regular and welcome caller to his show. Through those calls, Sean and I got to know each other a bit and at some point, I can't remember exactly when, Sean gave me the secret "Guest call-in number" at WABC so that my calls could always get on the air.
Liberal blogger John Amato at CrooksandLiars highlights Turner's blog posting in which he suggested that the lawmakers be made "an example of as a warning."
"It is our intent to foment direct action against these individuals personally," the blog stated. "These beastly government officials should be made an example of as a warning to others in government: Obey the Constitution or die."
And, the post continued, "If any state attorney, police department or court thinks they're going to get uppity with us about this; I suspect we have enough bullets to put them down too."

in sympathy with the Germans. He was known as Lord Ha Ha....after the war
in June of 1945 he was arrested by British forces...he was sent to London.

What is the state doing telling the church how it can govern itself? That does sound unconstitutional. I for one would like to know more about this bill. That being said, there are ways to impact a bills chance in becoming law that does not need to include violence.
I believe that we are drowning in law enforcement and that a 2/3 across the board cut in LE funding is in order. But I also believe that most Christian leaders should be in jail along with many of their flock. I would support Law enforcement if they would eliminate dangers to our society like Xians. 7, you are correct: The government has no business telling the Catholic church how to manage its affairs (no pun intended) as long as it does so legally. That is, so long as the Catholic church does not seek to tell the government how to run its affairs.

In fact, history teaches that if give half a chance, the Catholic church will take over the government entirely and then begin the slaughter of heretics, apostates or anyone else who has the temerity to think for himself or herself about matters of morality, sex, reproductive rights or anything else.
So try not to pretend the Catholic church believes in the separation of church and state, OK? As soon as the church stops its world-wide assault on legal abortion, the availability of birth control information and technology (which assault has also contributed mightily to the spread of AIDS), I will support its independence from government meddling.

Terrible
as shown by the absences of using all caps in my post (unlike someone else's post, no name need be mentioned) should make clear, I am a very calm person. All I did was say I would like to know more about this bill and that from what I had read so far it did sound unconstitutional. Further reading has shown that this article grossly understated what the bill was really about. That’s it. Nothing more. I made it very clear that violence is not the way to address an issue like this. I understand very well how our government works, as it was common to teach such material to school children starting around the 5th grade.
This is not good news. I hate hate speech laws..way too subjective for me.
Inciting is a pretty simple concept to understand, and the speech has to be pretty blatant for someone to be arrested and convicted.
This is not the beginning of the end, this is business as usual; after 8 years of letting psychos spew and incite, this just "appears" to be new to those who can't pay attention beyond the typical news cycle.
Plenty of people in our history have been arrested and convicted of inciting, it isn't the "begging of the end", it's what a sane society does when they want to punish those who seek to cause trouble for no good reason.
While our government may be well out of reasonable control and accountability, we still have the rule of law and a Democratic process. The masses being too ignorant and apathetic to find out the truth about their candidates, or put forth viable alternatives isn't grounds for select talking heads to advocate killing people.. Quite the contrary, it is a reason for them to EDUCATE and MOTIVATE people to act LAWFULLY and VOTE for their change. ... only when the process (not the actors) breaks down or is discarded are you justified in action other than voting.
The premise of inciting comes from the idea that too many people are simply too stupid to be motivated to do the right thing, so someone in a position of power (typically) encourages unstable people to do the wrong thing to the same end effect. If the populous gets their heads out of their asses, we could have change without need of violence.. but too many people are too stupid and lazy and listen to those that would abuse them instead of those that would help them. Vis a vis, "socialism" means providing for the "society".. how members of a society can think that's a bad thing is beyond me, yet here we are.

Incitement to violence is a long-standing exception to the 1st Amendment right to freedom of speech.
You cannot, for example, go to a party and tell a drunk guy to go rape a passed-out drunk girl, and when he does so then hide behind freedom speech.

I said “violence is not the way to address an issue like this.” The key words here are “an issue like this.” This issue in no way resembles the reasons Americans rebelled against England. Threatening to kill public officials who were put in office in a free, open and honest election, in order to intimidate them in performing their job as the Constitution directs them to is not the way to go about things. There are measures already in place for those that wish to effect change. If you want to live in a country where violence and murder are acceptable ways of getting publicly elected officials to do the job fringe elements of society want them to do, I suggest you look into residing in a country other than the U.S.

When people use their bully-pulpits to foment hate instead of unity it is counterproductive to moving forward as a nation, to be generous. I think nearly evryone wants the nation and, by extension, the world, to move on forward. Perhaps with a couple of exceptions like Limbaugh, Hannity, Beck, O'Reilly and a few other skanks (not to mention a few remaining dead-ender Confederate States) but, they are clearly unpatriotic narcissists.
But when a radio host or other with a public platform is using hate speech and clearly inciting violence (on the publicly-owned airwaves, by the way), even suggesting killing, I think the Feds are acting well within the framework of the Constitution to take it seriously and act on it legally if appropriate. I am going to bet most genuine Constitutional law experts like Turley, Horton and Greenwald would be in agreement, though Glenn Greenwald is said to be a free speech absolutist himself so I am not dead certain.

I don't understand how people can advocate that kind of behavior on the part of law enforcement and then object when someone who encourages the unbalanced elements on the right wing to kill someone gets arrested. I wish the law enforcement agencies would also get more serious about arresting the gun nuts who are directly planning to kill someone themselves.
It is possible, of course, that a lot of right wing nuts HAVE been arrested for planning terroristic acts, but we didn't hear about it because the MSM and the Cheney/Bush administration didn't want to make the right wing look bad. Already in hate crime legislation we have prosecution of people not for the acts that they can be proven to have done, but for what they are alleged to have been thinking at the time. Usually an alleged bad thought or politically improper attitude is imputed to them because of things they have said, thus they earn extra punishment for a crime over someone who did the crime without saying anything.
Thus we get into thought police and language police. I actually have heard many lefties say they would like to shoot Rush Limbaugh. Are those statements innocuous because no one has actually done it yet? If someone shoots Michael Savage, do threats against Limbaugh then become illegal and a basis for arrest? Why should what somebody else does to some other victim become a reason to arrest a particular American citizen? Who decides the close calls?
And what exactly is a threat to do violence, anyhow? I have heard many angry people use fighting words and taunting words and demeaning words. If a person threatens to "tar and feather" someone else is that an arrestable offence? (Often people were tarred and feathered after they were hanged, so that their bodies would serve as reminders to the public when left suspended in some prominent place.)
How about, "I'll kick your behind to the moon!" That would probably be fatal.

On June 3, 2009 Turner, writing on his blog from his home in New Jersey, referred to certain actions by Connecticut officials as "tyrannical" and opined that Connecticut citizens should "take up arms to put down this tyranny."
Even though no one actually did that, Connecticut issued a "Fugitive from Justice" Warrant for Turner's arrest anyway! Turner was arrested in his home town in New Jersey and held -- without bail, as a "fugitive" - for almost a full week until a New Jersey Judge realized Turner had never actually fled justice and was not a fugitive at all. The Judge ordered that Turner be released on bail.
Turner says Connecticut doesn't have a legal leg to stand on and cites U.S. Supreme Court case law to back-up his confident assertion.
Read about those cases at the First Amendment Center web site at the link below and pay particular attention to the case "Hess v. Indiana" which fits the Turner case in Connecticut almost perfectly.

There is MAJOR danger that affects YOU with this case: The Connecticut courts may choose to ignore federal case law and proceed with a trial anyway. The Jury may choose to convict. Turner could then be jailed pending appeals. The first Appeal would have to go to the Connecticut State Court of Appeals and that would mean Turner would sit in prison for months until that court ruled. The Appeals Court might choose to ignore the federal case law too and uphold the conviction. The next appeal would then be to the Connecticut State Supreme Court and would mean Turner would remain jailed for many more months waiting for that court to rule. The State Supreme Court may choose to ignore federal case law too, which would then finally allow the case to go to the Federal Courts where the law is on Turner's side. But as all of this is happening, Turner will find himself jailed literally for YEARS, waiting to win under the clearly established federal case law.
Imagine the impact on your life if this happened to you. Being jailed without bail, being forced to spend tens of thousands of legal fees, facing years in jail. . . . . . all for something you wrote on the internet!
The case of "Connecticut v. Turner" puts EVERY user of the internet at severe risk. Turner is not a citizen of Connecticut and he was not in Connecticut when he published his opinions on his blog. Yet Connecticut is forcibly applying its laws upon Turner!
If Connecticut can apply its law to a citizen of New Jersey and jail that citizen over words published outside the jurisdiction of Connecticut, then ANY state can apply its laws to ANY blogger, web site owner, MySpace, FaceBook, Twitter or even YouTube user!
How would this affect you? Simple: People you never met, in places you've never been, can take offense to something you write on the Internet and have you jailed in THEIR state for it! Do you see the risk now? Do you understand how important this case is going to be?
It is absolutely essential for anyone who publishes anything on the net, to support Hal Turner in this Landmark legal battle. The freedom of speech for ALL net users is literally at stake.
That's why Hal Turner needs our help. Since his arrest on June 3, Turner has had to pay over ten thousand five hundred dollars for two separate Bail Bonds - one in New Jersey ($2500 paid for bond of $25,000) and another in Connecticut ($2500 for another bond of $25,000) plus another $3500 for a lawyer in New Jersey and another $2000 for a lawyer in Connecticut! These legal fees cover only pre-trial legal work and DO NOT cover going to Trial. The expenses of going to trial will be triple or quadruple the initial amounts and, if Connecticut Courts ignore case law (which they can do) the appeals process will cost tens of thousands more.
If Connecticut is able to grind Turner into financial oblivion to get him to plead-out, then the precedent for applying their laws to bloggers OUTSIDE of their state would be set -- and ALL of our freedom of speech will be in immediate jeopardy.
That's why it is so important to help with a contribution right now. This case will be as important to freedom as the Miranda case which gave us the "Miranda Warning" 40 years ago.
