A U.S. court ruled recently that after seven years in captivity, 17 Uighur men captured in the terror war and held at Guantanamo Bay should be brought to Washington D.C. and released.
The Obama administration, acknowledging the court's authority to free the prisoners, asked the Supreme Court to ignore appeals by the men and argued that the lower court has no authority to order the men released in the United States.
In a brief urging the high court not to hear an appeal from the 17 men, the Justice Department said the U.S. Court of Appeals for the D.C. Circuit acted correctly earlier this year when it overturned a district court judge's order that the men be brought to the U.S. for release.
"Petitioners would like the federal courts to order that they be brought to the United States, because they are unwilling to return to their home country. But they have no entitlement to that form of relief," the brief submitted by Solicitor General Elena Kagan said. "As this Court has recognized repeatedly, the decision whether to allow an allied abroad to enter the United States, and if so, under what terms, rests exclusively in the political Branches."
Diplomatic efforts to settle the prisoners overseas are continuing.
Lawyers for the Uighurs argue they represent no threat to the safety of U.S. citizens and have sponsors awaiting them who would ensure they could be settled safely into their communities.
The high court's decision on whether to accept the case is expected to turn on the authority of courts to order any detained individual brought to the United States outside the nation's existing immigration laws.

There are also news reports that these Uighurs were interrogated in GTMO by Chinese military brought in for the job - think about that for a while!
Free the Uighurs. it is the right thing to do.
