Breckenridge, Colorado voters legalize marijuana, paraphernalia

 Breckenridge, Colorado voters legalize marijuana, paraphernaliaVoters in the ski resort town of Breckenridge, Colorado legalized marijuana and marijuana paraphernalia by a nearly three-to-one margin on Tuesday.

It is the first municipality in the United States to allow paraphernalia, such as pipes, bongs and bubblers.

"[The measure] passed 73 percent to 27 percent," ABC 7 News in Denver reported.

"'This votes demonstrates that Breckenridge citizens overwhelmingly believe that adults should not be punished for making the safer choice to use marijuana instead of alcohol,' said Sean McAllister, a Breckenridge attorney who proposed the ordinance," ABC continued.

"Possession remains illegal under state law, but Breckenridge Police Chief Rick Holman said his department will 'still have the ability to exercise discretion,'" Colorado's Summit Daily News added.

“It's never been something that we've spent a lot of time on, so I don't expect this to be a big change in how we really do business,” he said, according to the Daily News.

"It will not make it more available to minors, won't make it legal to smoke it on the street, won't get you out of trouble if you're stoned behind the wheel," the Daily News opined in an editorial supporting the measure. "What it says is that if you, as an adult, choose to possess small amounts of marijuana for personal use, you won't be busted for it. It's still a much more stringent law than those that apply to alcohol — a substance you can own as much as you want of and consume in public."

The paper added: "Eventually, it seems these small possession busts will be a thing of the past state-wide, which makes us conclude some kind of 'nuisance pot smoke' ordinance needs to take their place — roughly analogous to public intoxication statutes."

In Breckenridge, which has about 3,300 registered voters, passage of the measure is not a surprise. While an effort to legalize marijuana state-wide failed during the 2006 elections, Breckenridge voters supported it by a margin of nearly 3-to-1. Additionally, the petition to levy a ballot measure that would legalize marijuana needed just under 500 signatures, but organizers collected over 1,400.

    A good place to ski/SNOWBOARD and a great town just got better. The already friendly town will become even more groovy. Can't wait until the Uhler parade this year. I have a feeling you will see an increase in population and property value in Breck. and a few brownie and cookie shops opening

  • What makes you folks in Breckenridge think the 'users' will obey your new 'small amount' law? They obviously did not obey the NO Possession-No Use Law. Drug users are NOT to be trusted. Possession is no assurance that the user has not 'smoked' several joints just before being apprehended and questioned. Users pose a risk on the streets, roads and slopes. Their perceptions of place, speed, distance and morality are distorted and thus pose a danger to those around them. You have lit the fuse on a proverbial stick of dynamite. Some second thoughts may be in order. Does the order apply to everyone (Police on duty, medical personnel on duty, teachers)? Are there stated safeguards? Regardless, I will NOT be bringing my grandchildren and great grandchildren to Breckenridge on my next visit to Colorado.

    Those who broke the law by possessing marijuana prior to passage of the 'small amount' law will, most assuredly, exceed the permitted amount. Excuse: "Geez, it's only .01 grams over the limit. Let me just smoke it and we forget about it, OK?" There is no such thing as, just a little bit pregnant or just a liittle bit high. Either you are or you aren't. No drug user can be presumed 'safe' around children. You folks just lit the fuse on a veritable stick of dynamite.     Most of the cops in every state take the pot from the people they pull over anyways. And they keep it or sell it for themself. So why not let us buy it. At least we know what we are buying is not layced with something off the street. Do you want people to keep dying from things like that? Besides it helps out alot of people that are sick.     We need to legalize all drugs! This is a start and long overdue, but much more work there is to do!. How this country could be so stupid as to have pot illegal while cigarette and alchol are legal and kill more people then all streets drugs combined, is hard to understand.

    Bravo Colorado! Or Brekenridge thank God someone has the good sense to stand up against the onslaught of stupidity overwhelming our nation. George Washington was a hemp farmer the declaration of independance was penned on it. It was legal until the Dupont Corporation discovered nylon and soon found that nylon fibers were vastly inferior to hemp fiber. Hmmm how can we condone something that requires petroleum to produce, when a better substitute is readily available, that our farmers can produce?

    I think this is a good move and it's about time people in this country can relax and take a hit or two off of the bong or a joint without worrying if they are going to get arrested or not.     Colorado resident here and proud bud smoker. I'll be toastin' Breck at 4:20 this afternoon for being progressive and having common sense. Colorado is becoming a very progressive place. We are fiercely independent in many ways. We welcome all comers as long as you're open minded. Move on over to CO...the bud is fine!!!!!!

As a Breck resident I do know Rick Holman, he is a great Police Chief, far from being the idiot that you've shown yourself to be and yes he has the ability and the right to exercise discretion to enforce the laws of the city re: possession and use of marijuana is someone chooses to abuse the laws, dork. If you read the article properly, but based on your comment perhaps you need to work on your literacy & comprehension, and if you actually knew the Chief you would then know that he's not interested on busting people without them giving him and his police force just cause.
