Idaho man sodomized by police Taser plans to sue

A Boise, Idaho, police officer who pushed a Taser inside a man’s buttocks and threatened to “Taser his balls” violated use-of-force policy, but didn’t break the law, an ombudsman has found.
The man in question, whose identity is being withheld, plans to sue the Boise police.
On February 14 of this year, the “complainant,” as he is called in police reports, physically blocked the door to his residence when police arrived to investigate a domestic disturbance. Believing the police officers, who he claims did not identify themselves, to be a person coming to “beat him up,” he refused to allow them entry.
When officers forced their way in, “three officers rushed in and within nine seconds, had the man face down on the floor and had deployed the Taser against the small of his back. Only after the first [tasing] did they order his hands behind his back,” reports the Boise Weekly.
In a report, Boise Community Ombudsman Pierce Murphy “said the officer who used the Taser — described as Officer #3 in the report — also coarsely threatened to use the Taser in the man’s anus and genitals. Murphy’s report says that use of Taser on a man’s buttock’s does not violate policy in and of itself,” reports the Idaho Statesman.
The Statesman printed a transcript of an audio recording of the altercation:
Officer #3: Do you feel this?
Complainant: Yes, sir.
Officer #3: Do you feel that? That’s my -
Complainant: Okay
Officer #3: -Taser up your ass.
Complainant: Okay
Officer #3: So don’t move.
Complainant: I’m trying not to. I can’t breathe.
…
Officer #3: Now do you feel this in your balls?
Complainant: I do, sir. I’m not going to move. I’m not gonna move.
Officer #3 Now I’m gonna tase your balls if you move again.
A minute later, this exchange occurred:
Officer #3: Okay, I’m gonna take this Taser out of your asshole now. Are you going to fight with me?
Complainant: No, not at all, sir.

The Statesman is now reporting that the complainant “plans to sue the Boise Police Department for excessive use of force.”
The Boise Weekly quotes Boise Police Chief Mike Masterson as saying the allegation against the officer is “one of the most serious charges that an officer can face … It is an offense that is very likely to lead to termination.”
But the complainant’s lawyer, Ron Coulter, said that the officer in question is still walking his beat.
“I don’t think he should be back on the street, but then I’m not the chief of police,” Coulter told the Boise Weekly. “When you do things like he did I’m not sure that person’s even fit to wear a uniform.”

DIDN’T TRAIN that cop to be disciplined.

Perhaps it’s not “illegal” according to the omsbudman, but it is certainly beyond the definition of reasonable force. I also take exception with the cops insisting that this guy “heard” them identify themselves as “Boise police.” Even when he is was in great obvious pain, he kept telling them he HADN’T heard them. The female bitch cop was just as repulsive in this confrontation.
I hope the man sues for a billion dollars for intentional inflction of bodily pain, distress and whatever else can be thrown at these bastard cops. There is absolutely NO EXCUSE for this.
It is no wonder that more and more people across the country are distrustful of police. I certainly am, and I never was before.

Another massive problem citizens are subjected to on a daily basis. Taser happy cops.
I used to live in Idaho and can tell you that the Boise police department has been known for years to be a brutal bunch. They used to have a problem with suspects mysteriously, viciously beating themselves and/or hanging themselves in their cells. The BPD and Couer d’alene Police Department are well known for having suspects doing weird and mysterious stuff to themselves. For years they both recruited cops who had been suspended or fired from the Californica area.
Don’t know if things have changed, but after reading this article I would say they haven’t.

Actually the self defense laws we have would work if the juries quit believing cops over people and if the judges and prosecution were forced to reveal all evidence collected and make all the piggies testify. There’s a new ‘reality’ show being promoted. It’s suppose to be about female deputies (Florida, I think). The ’sexy’ one makes a comment about there ‘always is a good reason to use a taser. ‘ While most of the female cops I’ve encountered don’t so seem wrapped up in appearing as a ‘tough guy’ as possible there is always the exception. Too bad this bitch is being held up as an example as a good cop. Ick.
Spot on atilla, spot on. We have allowed without checks or balances or doubt monsters that know they are above the law. When a Police officer and his dept. and his Union demands the PRESIDENT OF THE US to apologize for something he said, they are saying something. They are saying that we are the ones that are powerful and your officials aren’t. They keep using 9/11 as an excuse to do anything and calling themselves first responders, yea your first responders but you can’t break the law. Isn’t it any wonder that many veterans are coming back from the wars and wanting to go into the police dept.. It’s because they know that they are considered better than the regular public and can get away with anything.
It’s truly amazing that they don’t consider what he did wrong but not per policy of the police dept.. What the police officer attempted to do and really did was torture the victim. As I have posted on another thread, I’m starting to believe that our own politicians are afraid of the monsters they have made and are acting like they run things when in reality they are just figure head. People in this country that thinks this won’t happen to them but to THOSE PEOPLE, should consider what happens in a police state. Eventually everybody becomes THOSE PEOPLE.

Without any sort of conviction the out-of-work, butt-poking cop is free to pursue another profession, like priest.
This crosses over the line “excessive use of force” and is rather “cruel and unusual punishment” and “intentional humiliation” and “torture”. Threatening to shock genitals is torture.
Something tells me that the ombudsman would have like it if the cop would have done it to him. He probably also would have liked it if the cop had pulled the trigger. How bout it, ombudsman, you got the balls to have it done to you? Then you can say that the cop didn’t do anything wrong.
More disturbing is the fact that these guys are backed by so may people.
It doesn’t matter how much training a department gives its personnel, you’ll still have assholes who don’t get the message. One way for them to get the message is to sue the living crap out of them personally, not just as an agent of the department or agency. Knowing they can lose everything they worked for and having their future pay garnished for life to pay off a civil suit would end this crap real quick.

The taser issue is being repeated over and over again. I think it’s time to re-think the taser as a law enforcement tool since there have been countless abuses and even some DEATHS because the the abuse of the item.
Threatening to taser a man’s testicles? Why didn’t the cop go ahead and do it? Honestly what was stopping him? Is that where it’s going next?
How did police handle these things before the taser? What about pepper spray or some other less severe method which is harder to abuse? Tasers seem to be the answer to everything for some cops.

As long as it looks like it’s being done to THOSE PEOPLE, then they feel they are okay. The problem with this thinking is when they do come around to the thinking that this is wrong it’s to late, and nobody is out their wanting to or is afraid to protect them. A nation is also known by the way they treat their people and how many people they jail. We in the US are second I believe to China in the amount of people that we jail in this country. This used to only happen to the blacks, hispanics, downtrodden, and the “dark” people over the decades. Now it has progressed to the whites just as much as the blacks and others in increasing frequency. In any police state, the police and govt. officials want the perks that come with the job. And most of the perks they want are located in the middle class. If a cop or govt. official sees a guy that has a hot wife or girlfriend or even daughter, he may (sorry WILL) make your life difficult and try to break you up with her. If they are jealous (which many are), they may hate your life your money your anything and decide to destroy you and take what you got. And women who think this is Noble or think that attraction to power is no big thing should read many of the abuse articles that are out their from women not only married to other men but cops especially.
The elite get to pick over everyone and anything in the country at their leisure in a country, the police and lower govt. officials must hunt and stalk and harass to get what they desire from the country and the people. Poor people don’t have much, but who does have alot is the middle class and the upper class that isn’t connected. They are starting to prey on them now.

We are seeing Police commit crimes but never being charged. They murder, harass and even arrest people for going in their own homes. Many officers even pull over woman and rape them but never charged as we see the GOP doesn’t believe woman should have rights as they have done their share of sleeping around. Mark Foley’s young male victims know they can’t charge Mr. Foley for molesting them as our Law Makers made it legal and protected Mr. Foley. Even the woman who charged then Gov. George W. Bush with rape was soon found murdered and quickly the investigation was dropped. Morning Joe’s secretary was murdered and he had the investigation dropped and quickly resigned from office. Dick Cheney had an Assassination Squad that killed when ordered as with Pat Tillman and even UK’s Dr. Kelly and many more people. Americans justify this conduct because Republican Law Makers are our examples of Christian Religious Family/Moral Values we all should follow.
They should taser that cop’s balls. The deal should be: you can keep your job as a cop, if you get your balls tasered. That’s fair.
It is well past time to deal with this abuse of authority.
