Obama’s Justice Department seeks embarrassment exception for Cheney

President Barack Obama’s Justice Department is being very generous to former Vice President Dick Cheney, who has emerged a fierce critic of the current administration.
Arguing before Washington, D.C. District Court Judge Emmet Sullivan, Justice Department lawyer Jeffrey Smith said Tuesday that the court should not unseal Cheney’s interview with prosecutors during the Valerie Plame case because it could make future vice presidents hesitant to cooperate with investigations. He added that Cheney’s words could also be used for political embarrassment and must be kept under wraps until it can only be used in a “historical context.”
Smith has previously argued that the court should keep Cheney’s words secret because they may turn up on Comedy Central’s fake news program The Daily Show, embarrassing the former vice president.
He asked the court to delay disclosure for 10 years from the day President George W. Bush left office.
“Sullivan sounded highly skeptical of the government’s arguments, but he said he had not decided how he would rule in the case ‘Where do I draw the line? This happened five years ago,’ the judge said,” according to Politico. “‘Would there be impediments to putting this information in a time capsule?’”
The judge also complained that Obama’s Justice Department seemed to be asking him to create a vice presidential exception to the Freedom of Information Act — to legislate — “something courts can’t do,” he reportedly said.
“It sounds like Emmet Sullivan is not buying that argument–though he is also unwilling to just order the release of the interview without giving Obama’s DOJ an opportunity to waste more money protecting Cheney from embarrassment,” rattled blogger Marcy Wheeler.
Perhaps the most egregious argument given by Smith fell on the last line of Politico’s report: “‘Presidents don’t really have to cooperate if they really don’t want to,’ Smith noted, referring to President George H.W. Bush’s refusal to agree to an interview sought by Iran-Contra independent counsel Lawrence Walsh.”
While it is true the first President Bush refused to be interviewed in the Iran-Contra scandal, he said repeatedly in public that he was cooperating fully. The statements were seemingly in reference to his 1988 interview with the Office of Independent Counsel over the scandal. Later, in 1992, the OIC approached Bush again with more questions, specifically regarding his personal diary, but the White House refused while still publicly claiming “full cooperation.”
The OIC weighed the option of forcing the president to answer questions by forming a Grand Jury, but the idea was later dropped and seen as inappropriate should the proceedings not result in a criminal prosecution.
On Tuesday, President Obama reportedly granted a request from Cheney to extend secret service protection for the former vice president. Cheney’s security detail was set to expire six months after he left office. The extension grants him another six months of taxpayer-funded, personal security detail.

At some point, as in Watergate, the house of cards will have to fall and the theme will be the rule of law. That’s the standard needed here to open what will result in a daisy chain of investigations. The entire premise of the argument to keep this info sealed is because if it comes out, there’s no way in hell “they” will win an election for at least a decade. There is a clear pattern here, perhaps clever, time will tell. Obama is consistently resisting disclosures, pursuit of prosecution, criticism of the past administration, etc. Why would he do this? Because he can deny that he set out on a vendetta. He can avoid creating more right wing backlash. In the meantime, he can rely on courts and aggressive allies to push hard and force out the information and force legal consequences. His people can assist with covert support and timely unauthorized leaks and other tactics. We can see this with Gitmo and the don’t ask, don’t tell policy. He is letting others do the mean and nasty work while he works to maintain distance from the efforts. It is frustrating to watch but I am persuaded that this is the strategy. I am also reluctantly impressed because I think it is a strategy that will work. He will be able to say that the system has brought about action on Cheney, Bush and others and that it was not him so it was not political. This means that others must do the work and push hard to help create the cover necessary to bring about justice.

You are looking at the facts and they support your assertion that Obama is more of the same. His officials have repeatedly taken positions that are defending past policies and actions. You are right that he is still waging war and Gitmo is still open and the criminals are still free and he has a mandate to change. I do not want to believe, as you do, that he is bush-lite. I want to believe there is a method to what he is doing. The thing I find curious is why bush didn’t pardon cheney and others in his regime when he had the chance? I’m glad he didn’t, but I do wonder about it. Was it just a parting “fuck you” gesture by bush to cheney and others for some unknown reason, or was there some kind of secret deal made by Obama to not pursue prosecution for the crimes committed by the bush regime?
There is no acceptable explanation as to why Obama, his attorney general and our congressional reps keep dragging their feet on prosecuting the bush/cheney war criminals–particularly when it’s not a matter of if they broke the law–cheney has publicly admitted as much.
It’s not a matter of “if” bush/cheney lied us into Iraq–it has been well established that they did, in fact, lie to the American people to trick us into supporting a war against a nation they knew had done nothing to us. And in the current age, wars of aggression are classified as war crimes.
And it’s not a matter of “if” they tortured–it has been well established that they tortured people and that they did so at least in part to gain false confessions in order to establish a link between 9/11 and Iraq (and I suspect false confessions for 9/11 itself)–torture that ended up killing AT LEAST 100 detainees and I suspect many, many more. In the current age, torture is classified as a war crime. And torturing people to death is considered a heinous and dispicable crime against humanity.
And on and on and on the criminality/corruption goes….
Yet all we seem to get is one “dog and pony” show after the next–one excuse after the next–one delay after the next. Well, fuck that! I’m tired of excuses, coverups, dog and pony shows. They either produce the results that the majority demands or they can kiss their political careers goodbye–and that goes for each and every one of them, repub or dem, president on down–and then we’ll go after complicit politicians for aiding and abetting known war criminals!
This kind of behaviour by Obama’s appointee lawyers disgusts me. Obama was supposed to be an agent of change. He appears to be very similar to Bush on violating Federal Laws and our Constitution.
